1. General Provisions and Definitions

1.1 The e‑Mobility services (“Services”) are offered under the trade name [Insert local brand name], managed by the Provider in the Kingdom of Saudi Arabia (KSA).

1.2 These General Terms govern the relationship between the Provider and the User regarding the use of electric vehicle (EV) charging infrastructure and billing systems.

1.3 This agreement is governed by the applicable laws of the Kingdom of Saudi Arabia, including but not limited to:

  • The Electronic Transactions Law
  • The E‑Commerce Law
  • The Personal Data Protection Law (PDPL)
  • Relevant SAMA and ZATCA (VAT) regulations

1.4 The Provider operates a digital platform accessible via mobile application and website for locating, activating, and paying for EV charging sessions.

Definitions:

  • User: Any individual or entity who registers and uses the e‑Mobility Services.
  • Guest User: A person using the services without creating a full user account.
  • Charging Session: The period during which an electric vehicle is connected to a charging point and receives power.
  • Charging Infrastructure: All physical equipment and software systems used to provide EV charging services.
  • Partner: Third‑party infrastructure operator with whom the Provider has a roaming or interoperability agreement.

2. Contract Formation & Account Creation

2.1 Users register via the mobile application or website by providing accurate personal and payment information. This registration creates a User Account governed by this agreement.

2.2 The User agrees that services are fee‑based unless explicitly stated otherwise and accepts the current pricing at the time of use.

2.3 The Provider may deny registration or suspend services if:

  • The User has outstanding unpaid invoices.
  • False or incomplete information is provided.
  • Fraudulent activity or misuse is suspected.

2.4 Account data must be updated by the User. Failure to do so may result in service disruption or termination.

2.5 The contract remains in effect until terminated by either party, subject to the notice terms in Section 9.

3. Use of Services and Responsibilities

3.1 Users shall:

  • Use services in accordance with applicable Saudi laws and this agreement.
  • Avoid interfering with charging stations or software systems.
  • Notify the Provider of any malfunctions or safety issues.

3.2 Misuse of services includes:

  • Repeated emergency stops without cause.
  • Sharing login credentials or unauthorized use by third parties.
  • Use of multiple accounts to manipulate pricing or access.

3.3 The Provider may restrict or suspend access if:

  • There is evidence of breach, fraud, or misuse.
  • It is required for system upgrades or maintenance.
  • It is mandated by Saudi authorities for legal or security reasons.

3.4 Users are fully responsible for all activities carried out under their account. Any third‑party misuse due to password compromise is the User’s liability.

3.5 The Provider will use reasonable efforts to ensure service availability but does not guarantee uninterrupted service.
